This Privacy Policy applies to engagetalent.com, jobmarketmaker.com and any other websites (collectively, the “Site”) owned and operated by ENGAGE Talent, LLC, Job Market Maker, LLC and/or their affiliates (collectively, “JMM”, “We”, “Us” or “Our”).

Your privacy is very important to Us. This Privacy Policy was prepared because We believe you should know as much as possible about Our practices. It describes the information We collect on, or make available through, the Site and other products or services that are governed by terms of use that expressly reference this Privacy Policy (collectively, the “Service”), what may happen to that information, the security measures that We use, your rights with respect to your information stored or displayed in or through the Service and collected in connection with your use of the Service or the development of our database and Service. The use of information collected by our Service shall be limited to the purpose of providing the Service for which You have engaged Us.

2.1 Information We Collect

JMM develops and maintains a database (the “Database”) of industry, company, and individual profiles (“Profiles”).

Information collected for the development of an individual Profile and/or published in an individual Profile on the Service may include: name, title, company, current position, prior position, publications, articles by, about, or quoting an individual, links to social media postings by or about the individual, professional contact information, education, certifications, licenses, and similar information relating to the professional sphere of an individual.

Information collected for the development of a company Profile and/or published in a company Profile on the Service may include: general information about the company’s location, industry, links to social media, open job postings, stock performance, news, events, the name and title of the company’s officers and certain company employees, information obtained from or published by the company or published by third parties.

Information collected for the development of an industry Profile and/or published in an industry Profile on the Service may include: general information about the industry, companies associated with the industry, events, statistics, trends, and similar information related to the industry.

2.2. Our Sources of Information

JMM collects information about individuals, companies, and industries from a variety of publicly available and other proprietary third party sources, such as company websites, company blogs, non-confidential corporate records or reports (for example SEC filings, commercial registers), press releases, news articles, magazines, social media sites, and other content published by or on behalf of a company or published by data brokers or third parties in accordance with their terms and conditions for the collection, disclosure and sharing of information.

2.3 How We Use the Information We Collect

This information collected as described above is then compiled, processed and organized in order to create a Profile for each individual, company, or industry.

Each individual, company, or industry Profile is integrated into the Database, which is part of the Service. Subscribers of the Service may use it to conduct market research and identify talent.

3. Other Information We May Collect

3.1 Information We Collect Through Automatic Data Collection Technologies.

As you navigate through and interact with the Site, We may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including details of your visits to the Site, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website, and information about your computer and Internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services.

3.2 How We Use Your Information

We use information that We collect about you or that you provide to Us, including any personal information: to present the Site and its contents to you; to provide you with information, products, or services that you request from us; to perform analytics and improvements to the Services; for marketing purposes, including advertising on other websites; to fulfill any other purpose for which you provide it; and to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

3.3 Additional Limits on Use of your Google User Data (specific to users leveraging Gmail integration)

Notwithstanding anything else in the Privacy Policy, if you provide JMM access to the following types of your Google data, JMM's use of that data will be subject to additional restrictions:

JMM will only use access to read, write, modify or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read, and process emails and will not transfer this Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets. 

JMM will not use this Gmail data for serving advertisements.

JMM will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for JMM's internal operations and even then only when the data have been aggregated and anonymized. 

4. GDPR Information

JMM does not knowingly collect personal information from data subjects within the European Union. If We learn we have collected or received personal data from an EU data subject, We will delete that information. If you believe We might have any information from or about an EU data subject, please notify Us.

5. Children Under the Age of 13

The Site and Services is not intended for children under 13 years of age. No one under age 13 may provide any information to the Site. We do not knowingly collect personal information from children under 13. If We learn we have collected or received personal information from a child under 13 without verification of parental consent, We will delete that information. If you believe We might have any information from or about a child under 13, please notify Us.

6. Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of the Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact Us.

7. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The Database is stored on our secure servers behind firewalls. JMM doesn’t store any payment-related information, including credit card or bank accounts information.

The safety and security of your information also depends on you. Where We have given you (or where you have chosen) a password for access to certain parts of the Site, you are responsible for keeping this password confidential. Per the Subscription Terms and Conditions, you shouldn’t share your account access or password with anyone. If you believe that your account information has been compromised or stolen, we ask that you notify Us immediately.

Unfortunately, the transmission of information via the internet is not completely secure. Although We do our best to protect your personal information, We cannot guarantee the security of your personal information transmitted to the Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

8. To whom We may Disclose Information

In certain situations, JMM may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

JMM may need or be required by law or legal process to disclose information about visitors, subscribers or Profiles to third parties. This includes: (a) to actual or potential parties to a lawsuit that JMM is or may become involved in as required by law and when We believe that disclosure is necessary to protect our rights; (b) to comply with a facially valid judicial or governmental subpoena, warrant, or other order or legal process served on JMM by a court or a government institution that has asserted its lawful authority to obtain the information; (c) if JMM reasonably believes that such disclosures will potentially mitigate its liability; or (d) to enforce or defend its rights or any of its policies.

JMM may engage third parties to perform necessary business functions on its behalf, such as outside contractors or service providers (e.g. hosting company, consultants) for example, in connection with communications to users, payment processing and other aspects of Site operations. If it is necessary to perform their functions, these third parties may have access to individual or company information or Profiles.

Finally, if JMM sells a substantial portion of its assets or is acquired, reorganized, merged into another entity, goes out of business or enters bankruptcy, it is likely that subscriber, Profile and other business information (including the Database) will be one of the business assets transferred in connection with such a transaction. You acknowledge that such transfers may occur and that any acquirer or successor of JMM or its assets may continue to use your personal information as set forth in this Privacy Policy.

9. Changes to Our Privacy Policy

It is Our policy to post any changes we make to Our privacy policy on this page. The date the privacy policy was last revised is identified at the bottom of the page. You are responsible for ensuring We have an up-to-date active and deliverable email address for you, and for periodically visiting the Site and this privacy policy to check for any changes.
